EMI ESTIMATOR – TERMS OF USE

These Terms of Use (“Terms”) govern access to and use of the EMI Estimator application and related services (“EMI Estimator”), provided by EMI PRINTWORKS, INC. (“EMI Printworks,” “we,” “us,” or “our”).
1. PURPOSE OF EMI ESTIMATOR
EMI Estimator is a business tool used by EMI Printworks to prepare printing estimates, review historical pricing information, manage estimate-related information, and support internal production and invoicing workflows.
EMI Estimator is intended primarily for use by EMI Printworks and its authorized staff. Any customer-facing estimate, quote, or document generated through EMI Estimator is subject to these Terms and to any additional terms shown on the estimate itself.
2. ESTIMATES AND PRICING
Prices produced by EMI Estimator are estimates based on information available at the time the estimate is prepared. Final pricing may change if job specifications, quantities, paper, finishing, mailing requirements, shipping, artwork, production requirements, vendor costs, taxes, or other project details change.
An estimate is not a guarantee of final price unless EMI Printworks expressly states otherwise in writing.
3. QUICKBOOKS ONLINE INTEGRATION
EMI Estimator may connect to QuickBooks Online, a service provided by Intuit Inc., in order to retrieve business information that may include customers, invoices, invoice lines, and other accounting-related data used for internal estimating, pricing history, invoicing, and business workflow purposes.
QuickBooks Online access is authorized through Intuit’s authentication process. EMI Printworks does not request or store a user’s Intuit password through EMI Estimator.
Use of QuickBooks Online is also subject to Intuit’s own terms, privacy policy, and service requirements.
4. AUTHORIZED USE
Users may use EMI Estimator only for legitimate business purposes authorized by EMI Printworks.
Users may not:
• attempt to gain unauthorized access to EMI Estimator, QuickBooks Online, or related systems;
• interfere with or disrupt the operation of the application;
• copy, reverse engineer, misuse, or redistribute the application except as authorized by EMI Printworks;
• use the application or its data for unlawful, fraudulent, or abusive purposes.
5. DATA ACCURACY
EMI Printworks makes reasonable efforts to maintain accurate information, but EMI Estimator may contain incomplete, outdated, or incorrect data. Historical pricing information is provided as a reference and does not override current costs, specifications, or pricing decisions.
Users are responsible for reviewing estimates and related information before relying on them for business decisions.
6. AVAILABILITY AND CHANGES
EMI Printworks may modify, suspend, update, or discontinue EMI Estimator or any feature of the application at any time.
We do not guarantee uninterrupted or error-free operation.
7. INTELLECTUAL PROPERTY
EMI Estimator, including its design, software, workflow, pricing logic, and related materials, is owned by or licensed to EMI Printworks and is protected by applicable intellectual property laws.
Customer artwork, logos, files, and other customer-supplied content remain the property of their respective owners.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, EMI Printworks will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use EMI Estimator.
EMI Printworks’ responsibility for any customer print project is governed by the applicable estimate, order, invoice, and any other written agreement relating to that project.
9. THIRD-PARTY SERVICES
EMI Estimator may rely on third-party services, including QuickBooks Online and Intuit. EMI Printworks is not responsible for outages, changes, errors, or other issues caused by third-party services.
10. TERMINATION OF ACCESS
EMI Printworks may limit or terminate access to EMI Estimator at any time if access is no longer authorized, if these Terms are violated, or if necessary to protect EMI Printworks, its customers, or its systems.
11. GOVERNING LAW
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules.
